Financial insolvency of the firm and methods of solution to this problem

Master’s thesis "Financial insolvency of the firm and methods of solution to this problem" deals with management of receivables. The first part describes tools which can be used for the management of receivables after maturity or prevention before this type of receivables. In the second part the work is focused on management of receivables in the company. In this section the current status of this area in the company is summarized and more types of debt collection are proposed. Finally, ideas for improvement of management of receivables are suggested, e.g. in the area of client communication by sales representatives. Recommendations are also made for tools usage, e.g. sale of bad debts of transfer of risk to other subject.
Disturbed possession

This diploma thesis "Disturbed possession" deals with the theme of possession and its protection against disturbing. Possession as one of the basic institutes of law has seen several changes in its legal concept on the territory of the Czech Republic in the history. The Civil Code no. 89/2012 Coll. has brought the concept of possession and its protection which is based on the concept of the doctrine of law science from the First republic. As this "new" concept is discontinous with the previous concept of the Civil Code no. 40/1964 Coll. interpretation and application of this new concept will be rather complicated. This thesis firstly tackles the theoretical concept of possession - i.e. what the object of possession is, how the possession is acquired, lost and retained, what qualities there are of lawful possession, who can be the subject of possession. The second part of the thesis describes the historical development of the concept of possession. The last part of the thesis focuses on how possession is described in Civil Code no. 89/2012 Coll. In this part of the thesis characteristic features and nature of trespass are described. This problematics is also mentioned in the view of the Austrian civil law. Case law influence on Czech national and international arbitration Proceedings Abstract Arbitration proceedings represent, besides civil judicial procedures, one of the methods for solution of material disputes in private-law relations. Arbitration proceedings have been used for quite a long time. In our territory they were used already under the rule of Charles IV. For example, Jakub Krčín and Štěpánek Netolický, who were well-known artificial lake engineers, belonged among highly appreciated arbitrators. Significant development of arbitration proceedings was registered after 1949, when the Steady Arbitration Court was established at the Czechoslovak Chamber of Commerce in May 1949 and exists up to now under the name "Arbitration Court attached to the Czech Chamber of Commerce and the Agricultural Chamber of the Czech Republic". Legal regulation of arbitration proceedings was undergoing various changes. Resolving Business Disputes over Contractual Obligations at the EU level.

The master thesis first deals with definition of business contractual relationship (sources, formation, freedom of contract) and indicates ways of resolving disputes arising from it within the Czech legal code. Through defining the concept of cross-border element the master thesis attains on how to resolve business disputes over contractual obligations at the EU level. Core topic of thesis deals with jurisdiction in commercial matters, the law applicable to contractual obligations, alternative dispute resolution as well as the recognition and enforcement of judgements or of different rulings. The last part of the thesis deals with a practical procedure which shows how to resolve dispute between domestic businessman and foreign businessman via legal proceedings.
Debt Security and Recovery from Business Relations

The thesis deals with the debt security and recovery from business relations. The main purpose was to explain the issue of debts, to compare classic judicial proceedings with arbitration and to analyse particular legal cases of the company XY in terms of security and recovery. The result is the evaluation of company's legal steps and efficiency of used security instruments, the summary of advantages and disadvantages of the arbitration and the overview of the most frequent practical problems with potential solution proposal.
